These Terms and Conditions govern the legal relationship between MK Elite Tours ("MK Elite Tours", "we", "us", "our") and the Client ("Client" or "you") for the provision of travel services, including tours, transfers, and other travel-related services.

These Terms shall apply for the duration of the confirmed contract between MK Elite Tours and the Client and remain in force until a new contract is agreed upon. Any additional or divergent terms must be agreed in writing by both parties.

MK Elite Tours BV is registered with the Dutch Chamber of Commerce with registration number 96304405 and VAT number NL867554551B01.

1. Booking and Confirmation

1.1 Booking Process

Reservations can be made through our online platform or via email at Finance@mkelitetours.com. A booking is considered confirmed only upon receipt of full payment (100%) at the time of booking and the issuance of a confirmation email.

1.2 Confirmation

Once your booking is confirmed, you will receive a confirmation email detailing your travel itinerary, services provided, and any specific requirements. Please review this confirmation carefully and notify us immediately of any discrepancies.

1.3 Changes to the Itinerary

MK Elite Tours reserves the right to make minor changes to the itinerary when necessary. In cases of substantial changes, you will be informed immediately and provided with an option to either accept the new arrangements or cancel the booking.

2. Payment

2.1 Full Payment Required

The full travel amount (100%) must be paid at the time of booking. No payment installments or prepayments are applicable.

2.2 Payment Methods

Payments can be made via credit card, bank transfer or other methods as specified during booking. All amounts are quoted in Euros (€).

Any bank or processing fees incurred are the sole responsibility of the Client.

3. Cancellations and Amendments

3.1 Cancellation by the Client

The following charges apply in the event of a cancellation:

• 25% of the total amount if cancelled 6 days before departure
• 50% of the total amount if cancelled 3 days before departure
• 75% of the total amount if cancelled 2 days before departure
• 100% of the total amount if cancelled within 24 hours before departure

We recommend cancelling in advance to avoid unnecessary charges.

3.2 Notification

Cancellations must be submitted in writing via email by an authorized representative of the Client. If no confirmation of cancellation is received within 36 hours, the request will be considered not received, and the original booking will remain valid.

3.3 Amendments

Any amendments or changes to the booking must be requested in writing during our regular business hours. Additional fees, if applicable, may be charged.

4. Service and Performance

4.1 Included Services

The travel package includes the services specified in your booking confirmation (e.g., tours, transfers, accommodations, etc.). Any additional services not expressly included will incur extra charges.

4.2 Client Responsibilities

The Client must ensure that all travel documents (passports, visas, vaccinations, etc.) are valid and available prior to departure. MK Elite Tours is not liable for any issues arising from missing or incorrect documentation.

4.3 Information and Special Requests

You are required to provide accurate information regarding your travel and any special requirements. MK Elite Tours will make reasonable efforts to accommodate such requests, but cannot guarantee they will be met. Additional charges may apply for processing special requests.

5. Liability and Force Majeure

5.1 Limitation of Liability

MK Elite Tours will exercise reasonable care in the provision of its services. However, our liability is limited to the total amount paid for the booking. We shall not be liable for any indirect, consequential, or punitive damages.

5.2 Force Majeure

MK Elite Tours shall not be held liable for delays, cancellations, or changes caused by events beyond our control (e.g., natural disasters, terrorism, governmental measures, extreme weather, etc.). In such cases, we will offer suitable alternatives or, if necessary, a full refund in accordance with our cancellation policy.

6. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with Dutch law. Any disputes arising from these Terms shall be exclusively submitted to the courts in Amsterdam.

7. General Provisions

7.1 Entire Agreement

These Terms constitute the entire agreement between you and MK Elite Tours regarding your booking. They supersede all previous agreements or understandings, whether written or oral.

7.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

7.3 Amendments

MK Elite Tours reserves the right to amend these Terms at any time. Any changes will be communicated via our website or directly to you for bookings made after the effective date of such amendments.
